The former Police spoke’s person Andrew Felix Kaweesi, was gunned down in March/2017 together with his bodyguard Kenneth Erau and driver Godfrey Wambewa.
This was the communication of Assistant DPP Lino Anguzu to Justice Duncan Gaswaga of the International Crimes Division of the High court as the eight suspects appeared in court this morning, to know how their trial is going to proceed.
Two out of suspects are still in prison but the six are out on bail.
Anguzu informed Justice Gaswaga that DPP has not disclosed her intended evidence to the accused persons’ legal team, and has also not assessed the situation to make the necessary applications regarding protection measures for 30 Prosecution Witnesses.
Anguzu then asked Justice Gaswaga to allow the DPP more three weeks in order to disclose their evidence and exhibits in this case to the defense, so that the accused persons can ably prepare their defense.
Justice Gaswaga granted the State request to adjourn the case to the 21st/July 2020 but with a serious concern about DPP’s inability to have been prepared for the case in the past 3 years.
The accused persons include; Yusuf Mugerwa, Bruhan Balyejusa, Joshua Kyambadde, Jibril Kalyango, Yasin Nyanzi, and Hassan Kasujja are out on bail and have been present in court;
While Abdul Rashid Mbaziira and Alamandhan Higenyi followed the proceedings via video-conferencing from Luzira prison because they are still held on other charges of kidnap.
All eight men are facing charges of murder, Terrorism, and aggravated robbery which prosecution alleges were committed on 17th/March 2017 at Kulambiro in Nakawa Division.
Their Lawyer Anthony Wameli put the court on notice that he intends to raise a point of law to have his clients discharged, and the intended trial be declared a nullity due to the torturous acts the police meted on his them for which the High court awarded each of tthe80 million shillings.
