The General Court Martial in Makindye has handed an 8year, 8months and 6days jail term to convicted Boda Boda 2010 Patron Abdullah Kitatta and Police Officer DC Sowali Ngobi, for unlawful possession of fire and ammunition.
In passing sentence the seven-member panel led by Lt. Gen. Andrew Gutti, ruled that much as the convicts are first offenders, they deserve to serve the maximum sentence of 10years imprisonment because the offense they committed is rampant.
However, the fact that there is no proof that the guns they illegally possessed were involved in any crime, the Court deducts the time they have spent on remand, and that is one year, 3mths and 24days.
Lt Gutti also advised the convicts that they have a right of appeal in 14days from now if they are dissatisfied.
Kitatta’s Lawyer told journalists outside court that they are indeed not satisfied with both the conviction and sentence, and are going to appeal.
Evidence led by Prosecution’s Major Raphael Mugisha proved that on 20th/January/2018 at Vine Tea Hotel in Wakaliga Rubaga Division, Kitatta was found with a golden pistol with 5 live rounds of ammunition, while Detective Ngobi was found with an SMG rifle with 30 rounds of ammunition, without a valid firearms certificate, yet the said arms are ordinarily a monopoly of the UPDF.
